TIFOSI OFFESI POSSONO CHIEDERE I DANNI A BALOTELLI - OFFENDED FANS CAN BLOW THE WHISTLE ON BALOTELLI

«Un'associazione di tifosi potrebbe chiedere i danni morali di fronte al comportamento ingiurioso nei confronti della società per cui tifano tenuto martedì sera da Mario Balotelli». Lo ha detto il professor Luca Stanghellini, docente di Diritto civile all'università di Siena e coordinatore del convegno 'Gli interessi delle associazioni di tifosi di calcio tutelati nel diritto sportivo' in corso presso l'Ateneo senese. «È un'ipotesi di cui discutere - ha detto Stanghellini - ma a mio avviso già ci sono gli strumenti giuridici per ritenerla attuale anche se mai attuata. Sono problemi nuovi, lo scopo del convegno è discuterne». Questa ipotesi però non può essere intrapresa da un tifoso qualunque: «Parlo di associazioni di tifosi costituite giuridicamente, con uno statuto e un atto costitutivo - spiega Stanghellini - In certi casi possono configurarsi interventi giuridici tali da consentire di accedere a un giudice amministrativo, per impugnare ad esempio un provvedimento di esclusione dal campionato, o a un giudice ordinario, come nel caso di Balotelli che getta a terra la maglia dell'Inter, tenendo un comportamento offensivo e ingiurioso nei confronti di un simbolo del club e dei tifosi».
